PAYMENT
Online  Counter customers:
(a)   Goods can only be collected or delivered once full payment is received
(b)   Payments made by debit credit cards may be subject to 2% charge minimum order £10
Wholesale customers:
(a)    Payment is due CASH ON DELIVERY. For credit customers first day of the week or the last delivery of the month unless otherwise agreed in writing.
(b)    Customers shall pay interest on a daily basis at a rate of 6% per annum over the base rate from time to time quoted by Barclays Bank Plc on any monies not paid to Eating Options on the due date.
CANCELLATIONS
Cancellations are only accepted 24 hrs before collection or delivery. In exceptional circumstances the company will consider the progress of your order and charge accordingly and will inform you at that time.
VARIATIONS TO THE CONTRACT:
No variations or amendments to this contract shall be binding on Eating Options unless confirmed by it in writing.
PRICES
Prices are those ruling at the date of delivery and may be subject to alteration without notice.
CLAIMS
The company will not accept any claim in respect of their goods unless made on the day of delivery. Claims against alleged imperfect goods can only be considered after the items have been returned to us for inspection and in turn sent to our suppliers.
LIABILITY
(a)    In no circumstances shall the liability of Eating Options under any claim pursuant to condition 4 exceed the invoice value of the goods.
(b)    Eating Options shall not be liable for indirect loss or third party claims occasioned by delay in supplying the goods.
DELIVERY
All goods must be checked on delivery and receipts signed on delivery note. Receipts should be kept and checked against invoices.
GENERAL
All goods comply with appropriate food legislation relevant to the sale of food.
OWNERSHIP OF GOODS
All goods remain the property of Eating Options until payment has been received.
FORCE MAJEURE
Every effort will be made to carry out the contract but its due performance is subject to cancellation by Eating Options or to such variation as they may find necessary as a result of inability to secure labour of supplies as a result of any Act of God, War, Strike, Lockout or other labour dispute, Fire, Flood, Drought, Legislation or other cause (whether of the foregoing class or not) beyond Eating Options control.
LAW
These conditions and all other express terms of the contract shall be governed and construed in accordance with the Laws of England.
